Leaving a Legacy

Several members have asked us about leaving a sum on their death for the future benefit of the association.

Taking care of your family will always be your priority but we would be extremely grateful and indeed honoured to receive any such gifts which can contribute to the sustainability and ongoing work of our organisation.

As well as cash you may wish to consider bequeathing collectable items of fishing tackle, specialist books and memorabilia for which a vibrant market is developing.

The association would take steps to publicly recognise the generosity of members in the most appropriate manner unless you directed us otherwise.

You can make provision when drawing up a will, or if you have an existing will that you do not wish to amend it should be possible to add a simple codicil to bequeath a sum or specific items to the association.

 

A sample wording to incorporate in your will is as follows: -

 

  1. I give free of tax £ XX  to Avon and Tributaries Angling Association (Company Registered Number 3922135) of 3 Prospect Close, Keynsham BS31 1GJ.

  2. The receipt of the appropriate officer of the Association shall be a complete discharge to my Executors.  An Executor shall not be liable for making payment to any person who appears to be the appropriate officer unless at the time of the payment the Executor has knowledge of circumstances that call for enquiry.

  3. If the Association ceases to exist, changes its name or enters into insolvent liquidation before the time that the gift to it takes effect in possession, the gift shall instead be paid to such other organisation as my Executors decide having regard to the objects that were intended to benefit.

 

A sample codicil wording is as follows: -

​

In addition to the legacies given by me in my will dated XX/XX/XX, I give free of tax the sum of......./the following items.........../a percentage of my residuary estate to the Avon & Tributaries Angling Association. I direct that the legacy shall be used for the benefit of the Avon & Tributaries Angling Association at the discretion of the directors and that the receipt of the directors of the said organisation shall be sufficient discharge to my executors for the payment of this legacy.

A codicil needs to be signed, dated and witnessed as with the original will.

We would recommend you always seek legal advice before taking any action.
